Air rights are a kind of justice in the real estate development. In general, possess or rent land or a building gives one the right to use and develop the empty space above the property. These rights are the rights of the air. Supposedly, this legal concept is based on an old saying in America is cuius solum, ejus est usque ad caelum et ad inferos base ( "Who owns the land, owns land in the middle and towards the sky").

Human Air Unlimited existed when people began to own property. It was not really something that everyone before 20 Century worried. The first legal limits for air rights it had under the aircraft. After all, only the owner of an airspace that could be reasonably used. Obviously someone who does not all the sky above them, because the plane constantly trespassing.

In the U.S., the Federal Aviation Administration (FAA) has exclusive control of the airspace authority all determined solely on the standards and requirements of use. Normally, in the "uncontrolledlled "category of airspace, a pilot of the aircraft is low, as he / she wants to fly without prejudice to the obligation to maintain a distance of 500 feet of the population and artificial structures, with the exception of the takeoff and landing, and is not dangerous. Therefore, it seems that all the triumphs of the rights entitled person will be taken, especially in the vicinity of airports.

Specifically, the Federal Aviation Act provides: "The United States of the exclusive sovereignty of airspace of the United States." The Act defines navigable airspace "airspace above the minimum flight altitudes. .. Including the airspace, safe for take-off and landing aircraft."

In a city as businessmen in New York, Mr. Trump paid for by the owner of the property next to their "airspace", the neighbors of the construction of a building at the same level holds that they prevent, and thus that it depends on heliports and unsightly antenna towers or microwave. Basically, it keeps the neighbors or competeing with impedeing your business. In some cases, people will buy the air space of another company to build an aerial road or bridge between two buildings. with the purchase of the airspace of any future challenges of the bridge, because the building can not claim the title or the area where the bridge.
